1. The seller

The seller is MOTOKITDECO (MOTO KIT DÉCO), a motorcycle decoration workshop located at 27 Ain Chkef, 30000 Fez, Morocco. Phone and WhatsApp: +212 6 61 14 02 85. Email: contact@motokitdeco.ma. Full legal information is available in the legal notice.

2. Scope and applicable law

These terms and conditions of sale govern the sale of ready-to-fit decal kits and custom-made kits, as well as fitting services at the workshop. They apply in accordance with Law No. 31-08 enacting consumer protection measures (promulgated by Dahir No. 1-11-03 of 18 February 2011) and the Code of Obligations and Contracts (DOC) of 12 August 1913.

In accordance with Article 30 of Law No. 31-08, these terms can be accessed at any time from every page of the website. By placing an order, you confirm that you have read and accepted them. In the event of a conflict, any specific terms agreed in writing for a custom project (quote) prevail.

3. Products and prices

• Each kit is presented with its main characteristics (compatible motorcycles, contents, finish). Product photos are as accurate as possible; slight colour differences may appear depending on your screen.
• Prices are shown in Moroccan dirhams (DH). They are the total price payable, including any applicable taxes (Article 5 of Law No. 31-08).
• Delivery within Morocco is free: no extra charge is added to the displayed price.
• The applicable price is the one displayed when you order. For custom work, the price is the one in the accepted quote.

4. Ordering and confirmation

1. You place your order through the website form, on WhatsApp, by phone or at the workshop, giving your name, phone number, city and delivery address.
2. Before submitting, the order summary (products, total price, address) lets you check your choices and correct them (Article 29 of Law No. 31-08).
3. We call you or message you on WhatsApp to confirm the order. The order becomes binding once it has been confirmed.
4. The key information about your order (seller, product, price, delivery and return terms) is confirmed to you in writing, at the latest on delivery, by message or by a document included in the parcel (Article 32).

We may refuse or cancel an order where the address is clearly false, where fraud is suspected, or after repeated unjustified refusals of parcels. You will be informed, and no payment will be requested.

5. Payment

Payment is made only on delivery, in cash, in dirhams, to the courier when you receive the parcel. No online payment is offered: no bank card and no bank transfer. For fitting at the workshop, payment is made in cash at the workshop when the motorcycle is handed back.

6. Delivery

Delivery terms are set out in full on the Delivery and returns page. In short:

• Delivery is free anywhere in Morocco, with no minimum order.
• Preparation: 24 to 48 h after confirmation for ready-to-fit kits.
• Estimated delivery time: 2 to 5 working days in major cities, 5 to 10 working days in more remote areas.
• The parcel is delivered by a partner carrier. The courier contacts you before coming by.
• Custom kits: 5 to 10 working days of production from approval of the design preview, followed by the delivery time above.
• Delivery times may be longer in the event of circumstances beyond our control (bad weather, strikes, peak periods).

Unless otherwise agreed, the order is fulfilled within 30 days of its confirmation at the latest (Article 39 of Law No. 31-08). If a product is unavailable, you will be informed and may cancel the order free of charge (Article 40).

If you cannot be reached, the courier will contact you again for a new delivery attempt. The parcel may then be held at a nearby drop-off point. If we have no news from you after 7 days, the order is cancelled.

Transfer of ownership and risk

The kit becomes your property when you receive it and pay for it. The risk of loss or damage during transport remains with us until the parcel is handed to you. You may check the outside condition of the parcel (intact packaging) before paying; if the parcel is visibly damaged, tell the courier and contact us.

7. Right of withdrawal

In accordance with Article 36 of Law No. 31-08, you have 7 days from receipt of a ready-to-fit kit to exercise your right of withdrawal, without giving any reason or paying any penalty, except for return costs. This period is extended to 30 days if the information required by Articles 29 and 32 has not been confirmed to you in writing.

The return conditions are those on the Delivery and returns page:

• You have 7 days from receipt to tell us that you want to return a ready-to-fit kit.
• The kit must be unfitted, undamaged and in its original packaging.
• Return shipping costs are paid by you, unless the mistake is ours.
• Once the kit has been received and checked, the refund is made within 5 working days, by bank transfer to a Moroccan account or by mobile money transfer. This is shorter than the 15-day legal maximum set by Article 37.

Exceptions

In accordance with Article 38(3) of Law No. 31-08, the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised. The following therefore cannot be returned:

• custom-made kits (design, dimensions or colours made to your request), including personalised ready-to-fit kits (name, number, modified colours);
• kits that have already been fitted, even partially, as they can no longer be resold as new.

These exceptions never deprive you of the legal warranty against defects (section 9 below).

How to withdraw

Write to us on WhatsApp or at contact@motokitdeco.ma with your order number, photos of the kit and its packaging, and the reason for your request (optional for a withdrawal). We reply within 48 h and give you the return address.

8. Custom kits

1. Request: you describe your project and send photos of your motorcycle, or bring it to the workshop.
2. Quote: we send you a written quote (on WhatsApp or by email) stating the kit contents, price, lead time and whether it will be fitted at the workshop or delivered. The quote is valid for 30 days.
3. Preview: once the quote is accepted, we produce a visual preview of the design on your motorcycle. Reasonable changes are included until you approve it.
4. Approval: cutting only starts after you approve the preview in writing (a WhatsApp message is enough). From that point, the order can no longer be cancelled or changed.
5. Production: 5 to 10 working days, then fitting at the workshop or delivery of the kit.

As a custom kit is made specifically for you, it cannot be returned or refunded, except in the case of a manufacturing defect or a discrepancy with the approved preview. The on-screen preview is a simulation: slight colour differences between the screen and the printed vinyl are not a defect.

9. Legal warranty against defects

In accordance with Article 65 of Law No. 31-08, you benefit from the legal warranty against defects in goods sold provided for in Articles 549 to 575 of the Code of Obligations and Contracts. For movable goods such as a decal kit, any warranty claim must be brought within one year of delivery; this period cannot be shortened by contract.

If the kit has a manufacturing defect, or if you receive a different product from the one you ordered, we cover the return and either send you the correct kit or give you a full refund. Please report the problem as soon as possible, with photos.

The warranty does not cover damage caused by fitting that does not follow the advice provided (dirty or poorly degreased surface, fitting in very cold conditions, etc.), by a fall, by rubbing, by high-pressure washing at close range, or by normal wear and tear.

10. Intellectual property

Designs created by the workshop (drawings, previews, cutting files) are protected by Law No. 2-00 on copyright and related rights. Buying a kit gives you the right to fit and use it on your motorcycle; it does not transfer the rights to the design. Production files are not handed over, and the design may not be reproduced or resold without our written consent.

Logos and trademarks supplied by the customer

If you ask us to include a logo, name, trademark or image (sponsor, club, company, etc.), you warrant that you hold the necessary rights for that use, in particular under Law No. 17-97 on the protection of industrial property. You remain responsible for that use, and we may refuse a request that clearly infringes the rights of a third party.

11. Personal data

The data you provide is used only to process and deliver your order. How it is handled is described in the privacy policy, in accordance with Law No. 09-08.

12. Complaints and disputes

These terms are governed by Moroccan law. Failing an amicable settlement, and in accordance with Article 202 of Law No. 31-08, consumers may bring proceedings, at their choice, before the court of their domicile or place of residence, or the court of the place where the event causing the damage occurred. For business customers, the competent courts of Fez have exclusive jurisdiction.

13. Changes to these terms

We may amend these terms at any time. The terms that apply are those in force on the date of your order; the date of the last update is shown at the top of this page.
